In a class-action lawsuit, credited with affecting policy nationwide, the federal court declared the City of New York's Policy of removing children from battered mothers to be unconstitutional, and enjoined its illegal practices.

The Fall 2008 issue of the American Bar Association Commission on Domestic Violence eNewsletter is devoted to Nicholson v. Scoppetta, the groundbreaking class action for mothers who were victims of both domestic violence and state removals of their children. The case was brought by Lansner & Kubitschek and Sanctuary for Families (handled by Jill Zuccardy, who is now with L&K). The issue features articles by David Lansner of L&K and Joanne Sirotkin of My Sisters' Place. Joanne worked extensively on the Nicholson trial while an associate at L&K.
